Getting Married in South Africa from the UK
UK couples marrying in the Cape Winelands: documents, the no-impediment workaround, recognition at home, costs and best months.
Last checked: 5 October 2026
Vineyards, mountains and a long dry season draw many UK couples to the Cape Winelands. The paperwork needs care, mainly because the UK can't issue the "certificate of no impediment" that South African marriage officers usually ask foreign nationals for. This guide sets out what the official UK and South African sources say, where they leave gaps, and how to plan the rest: recognition at home, costs, timing and venues.
How we checked this
We used GOV.UK's marrying-abroad guidance, the Foreign, Commonwealth & Development Office (FCDO) note on no-impediment certificates in Commonwealth countries, the British High Commission Pretoria's letter, GOV.UK's South Africa entry requirements, the Department of Home Affairs (DHA) marriages page and procedures circular, and the South African Embassy in Washington. Links are under Sources.

This is not legal advice; confirm requirements with the Department of Home Affairs and your embassy or consulate before you book.
Can UK citizens legally marry in South Africa?
Yes. The South African Embassy in Washington says the Marriage Act 25 of 1961 doesn't distinguish between South African citizens and foreigners when it comes to solemnising a marriage. It also says there's no residency requirement and no blood test. You need a designated South African marriage officer, two competent witnesses and the right documents. Our guide to the legal requirements to get married in South Africa covers the general rules in detail.
Getting there is straightforward for most British travellers. GOV.UK's travel advice says that on a full British citizen passport you can visit South Africa without a visa for up to 90 days for tourism or business. Your passport must be valid for at least 30 days after the date you leave South Africa and have at least two blank pages. GOV.UK also notes that from 1 July 2026 all travellers entering or leaving South Africa must submit an online traveller declaration before they travel.
GOV.UK's advice is to check the local law and get advice from the person conducting the ceremony: your marriage officer.
The no-impediment problem, and the workaround
Why the UK can't issue a certificate
The FCDO's information note explains that, under the Consular Marriages and Marriages under Foreign Law (No. 2) Order 2014, a certificate of no impediment (CNI) can't be issued for a marriage taking place in a Commonwealth country. South Africa is a Commonwealth country. The note says this applies to British High Commissions and to register offices in the UK. It adds that the UK has no central civil register that confirms marital status, so no UK register office issues a certificate of marital status either.
GOV.UK's page on notarial and document services goes further. It says British High Commissions and consulates in Commonwealth countries can't provide any notarial services, including administering the oaths and affirmations that prove you're free to marry. You need a local notary public or commissioner of oaths instead.
What the British High Commission's letter says
GOV.UK publishes a one-page letter from the British High Commission Pretoria titled "Certificate of No Impediment", addressed to the South African Department of Home Affairs. It explains that the High Commission can't issue CNIs and says:
The Department of Home Affairs have confirmed to us that you should instead show your British passport and provide a copy of this letter and a sworn affidavit stating that you are not married, and that there is no legal impediment to your intended marriage.
So the route described by the UK side is:
1. Download the letter ("South Africa: certificate of no impediment") from GOV.UK's "Confirm a notarial or document service is not available" page. GOV.UK says stamped and signed versions of these letters cost £50 but are only available in some countries. Ask the High Commission whether one is available for South Africa and whether your marriage officer wants it. 2. Swear an affidavit in South Africa before a commissioner of oaths or notary public, stating that you're not married and that there's no legal impediment to the marriage. 3. Show your British passport with the letter and affidavit.
Where the sources don't line up exactly
DHA's own marriages page lists a "letter of no impediment" for a foreign national marrying a South African citizen. DHA's procedures circular says that letter should come from the authorities of the foreigner's country of origin and be authenticated unless it's apostilled. The South African Embassy in Washington describes a "notarized declaration" of no lawful impediment instead. None of the DHA pages we read mentions the UK exception directly. The only official statement of the workaround is the High Commission's letter.
These positions overlap but aren't identical. Before you travel, ask your marriage officer to confirm in writing exactly what they and their Home Affairs office will accept:
- Is the downloaded letter enough, or do they want a stamped and signed version?
- Should the affidavit be sworn before a commissioner of oaths, or notarised?
- Should each British partner swear a separate affidavit?
GOV.UK's online "prove you're free to marry" service is also worth checking with South Africa selected, in case the FCDO's offer changes.
Documents checklist for UK couples
| Document | Who needs it | Notes |
|---|---|---|
| Valid British passport | Each British partner | At least 30 days' validity after you leave South Africa, two blank pages (GOV.UK) |
| Second form of ID | Each partner | The Embassy says two valid IDs, one with a photo. Ask your marriage officer what they'll accept |
| British High Commission "CNI unavailable" letter | Each British partner | Downloaded or stamped version: confirm which |
| Sworn affidavit: not married, no impediment | Each British partner | Sworn before a South African commissioner of oaths or notary |
| Decree absolute or final order | If previously divorced | DHA lists a final divorce decree. Ask whether it needs an apostille |
| Death certificate of former spouse | If widowed | Listed by DHA |
| Proof of lawful stay | Each foreign partner and foreign witness | Your passport entry stamp. DHA's circular says the visa or permit is verified by an immigration officer |
| South African ID and DHA-31 declaration | If one partner is South African | DHA lists the declaration and an immigration report |
| Two witnesses' IDs or passports | Witnesses | Foreign witnesses need passports and proof of lawful stay |
Birth certificates aren't on DHA's published list, but ask your marriage officer whether they want them. If a document needs an apostille, the UK's legalisation service is on GOV.UK ("Get your document legalised").
Two British partners vs marrying a South African
If you're both British, DHA's circular says no immigration interview is needed when both partners are foreign nationals, though your marital status must still be verified. The circular also says two foreign spouses receive a handwritten abridged marriage certificate, and applying for an unabridged one is optional and paid.
If one of you is South African, the circular says both partners must be interviewed by an immigration officer at a designated Home Affairs office before the wedding. The officer issues a declaration letter covering identity, status and whether the marriage might be one of convenience. The marriage is then recorded on South Africa's National Population Register. Build it into your travel dates; no official source we read gives a waiting time.
Will our marriage be recognised back home?
GOV.UK states that a foreign marriage is recognised in the UK if:
- it was lawful in the country where it took place, and
- it would be allowed under UK law.
GOV.UK is also clear that you can't get a UK marriage certificate for a marriage that took place abroad, because only UK marriages are registered in the UK. Your South African certificate is your proof of marriage.
That makes the right South African certificate important. DHA's form BI-130 says an abridged certificate generally serves for use within South Africa, while an unabridged certificate is mainly issued for use overseas. Apply for an unabridged certificate and keep it with your important documents. DHA says its offices have issued unabridged certificates for civil marriages on the spot since 31 March 2025.
Legal ceremony vs symbolic ceremony
You have three realistic options:
1. Marry legally in South Africa. Your marriage officer performs the legal ceremony at your venue or elsewhere, using the CNI workaround above. 2. Marry legally in the UK, celebrate in the Winelands. GOV.UK suggests this itself: if you want a UK marriage certificate, you can have a legal ceremony in the UK and a commitment ceremony abroad. A short register-office ceremony at home means the wine-farm ceremony can be whatever you like, with no South African paperwork. 3. Sign legally in South Africa separately. Complete the legal formalities with a marriage officer at another time or place, then hold a celebration ceremony at the farm.
Option 2 is simplest on paper; option 1 keeps your legal date and celebration together. If you choose option 1, discuss your venue with your marriage officer, because the Marriage Act describes specific kinds of places for solemnisation.
Timeline: from booking to wedding day
Official sources don't publish processing times, so here's an order of work rather than deadlines:
- 12 to 18 months out (peak season): choose your date and venue. Cape Town Data's June 2026 venue guide says popular venues need 12 to 18 months' notice for a peak-season Saturday. That's an industry estimate, not a rule.
- Once the venue is booked: book a marriage officer. See how to find a marriage officer in South Africa, and get their document list in writing.
- Several months out: check passport validity, gather divorce or death certificates, arrange any apostilles and download or request the High Commission letter.
- Arrival in South Africa: leave working days to swear affidavits and, if one of you is South African, attend the immigration interview.
- The wedding: collect your handwritten certificate from the marriage officer.
- Afterwards: apply for your unabridged certificate.
Costs: rand vs pounds

UK benchmarks:
- Bridebook's UK Wedding Report 2026 puts the average UK wedding at £20,604, based on about 7,000 couples and excluding the engagement ring and honeymoon.
- Hitched's 2026 Wedding Industry Report puts it at £21,990, based on 2,020 couples who married in 2025, with an average spend of £272 per guest.
South African benchmarks (ZAR):
- The Wedding Directory's 2026 budget breakdown estimates R150,000 to R350,000 for a typical full-service wedding of about 100 guests.
- Cape Town Data's 2026/27 venue guide reports R45,000 to R150,000 in hire fees for wine estates on a peak-season Saturday, plus mid-range catering of R450 to R800 per guest.
These are industry estimates, not official statistics, and a destination wedding adds flights, accommodation and perhaps a planning trip. See our cost of a wedding in South Africa guide and our wine farm wedding cost guide, and always ask venues for current quotes.
Best months for travel and weather
Cape Town has a winter-rainfall climate. South African Weather Service normals for Cape Town (1961 to 1990, published by the World Meteorological Organization) show the lowest monthly rainfall from November to March (14 to 20 mm) and the highest in June (93 mm). Average daily highs peak in February (26.5°C) and are lowest in July (17.5°C). Summer brings the south-easter wind, and winter brings cold fronts. See our month-by-month guide to the best month to get married in Cape Town.
Choosing a Winelands venue from abroad
When you can't easily visit, prioritise:
- Accommodation on site or nearby, so guests aren't driving after the reception. Start with our list of wine farm wedding venues with accommodation.
- Transfer times from Cape Town International Airport and from where guests will stay.
- A real rain and wind plan, with an indoor space that fits your full guest list.
- Your marriage officer's view of the ceremony space, if your legal ceremony will happen there.

Frequently asked questions
Can I get a certificate of no impediment from the UK for South Africa?
No. The FCDO says a CNI can't be issued for a marriage in a Commonwealth country, and South Africa is one. The British High Commission Pretoria's letter says DHA has confirmed you should instead show your British passport, a copy of the letter and a sworn affidavit that you're not married and there's no legal impediment.
Is a South African marriage valid in the UK?
GOV.UK says a foreign marriage is recognised in the UK if it was lawful where it took place and would be allowed under UK law. You can't get a UK marriage certificate for it, so keep your South African unabridged certificate safe.
Do we need a visa to get married in South Africa?
GOV.UK says full British citizen passport holders can visit South Africa without a visa for up to 90 days for tourism or business. Check current entry rules before you travel.
Is it easier to marry legally in the UK first?
Often, yes. GOV.UK suggests a legal ceremony in the UK and a commitment ceremony abroad if you want a UK marriage certificate. It avoids the South African paperwork entirely, but your legal date and your celebration date will differ.
What if the sources disagree on our documents?
Follow your marriage officer's written instructions, and confirm with DHA and the British High Commission. Our wine farm wedding FAQ covers other common questions.
